Pair engaged in sex act on bench in front of office workers

Two teenagers engaged in a sex act on a public bench in front of a busy block of offices.

Dundee Sheriff Court heard an 18-year-old man and a 17-year-old female engaged in a sex act on a bench on a public footpath at Riverside Drive.

The path is in front of Compass House — a busy office block which looks directly on to the path and bench.

Fiscal depute Trina Sinclair told the court witnesses started work at Compass House at 9am on June 19 last year.

The fiscal said: “Around 3pm one witness went to use the photocopier and saw both accused sitting on a bench at the public footpath.

“She formed the impression they were having sex.

“She called on colleagues to have a look and see what they thought of it and they formed the same opinion.

“They saw accused the man cover the girl’s head with a jacket.”

Witnesses contacted police and security at the office block.

Security approached the pair — who were sat side by side on the bench by that point — and asked them to move away.

Police attended later and CCTV was reviewed.

The girl, who cannot be named for legal reasons, was identified by CCTV and traced at her own home.

She admitted the offence and being in the company of the man, who also cannot be named.

The court heard the female was a first offender and the man was currently subject to a community payback order imposed by the court for previous convictions of a different nature.

Both of the accused admitted that on June 19 last year, at Riverside Drive, they committed an offence of public indecency by engaging in a sex act.

The man was on bail at the time of the offence.

Sheriff Alastair Brown deferred sentencing to obtain a criminal justice social work report.

The sheriff said: “You are both over 16 and what you do in privacy is entirely your own business.

“But it is hard to think of anywhere less private than Riverside Drive at 3pm in front of a block of offices, on a bench on a public path which is heavily used by people who take their children for walks.

“You forced your own private activities on them and I take this matter seriously as it shows a complete disregard for the feelings of others.”

Sentence was deferred until Tuesday, March 22.


Vegan accused care home of poisoning residents

A VEGAN shouted that staff were “poisoning” residents at a care home by feeding them chocolate.

Dundee Sheriff Court heard that Duncan McLaren, 37, shouted obscenities at staff at Linlathen Neurological Care Centre, on Arbroath Road, when he spotted chocolate bars on a food trolley.

McLaren, of Forest Park Place, also mumbled about the murdering of animals and told staff not to feed chocolate to his mother, who is a resident there.

Fiscal depute John Adams told the court the incident took place on December 9 last year.

The fiscal said: “As the accused entered the centre he passed a trolley and saw lots of chocolate bars on it.

“He seemed to take exception to this because he is a vegan and mumbled something about the murdering of animals.”

McLaren then shouted: “You’re poisoning residents by giving them that.”

The fiscal continued: “The accused was described as red in the face and angry at that point.

“He went into his mother’s room and saw chocolate bars there and shouted, ‘She’s vegan, she’s not eating that’.

“He shouted obscenities and because of his demeanour and fear for other residents, police were contacted.”

When officers arrived, McLaren was cautioned and charged.

Solicitor David Duncan, defending, told the court McLaren suffered from Huntington’s disease.

Mr Duncan said: “Physically he does not suffer from his condition but he is noticing a decline mentally and he is having trouble.

“There’s been a long-standing issue between him and the people who give his mother care.

“He has always said he was able to care for his mother and until recently he did.

“He has a deep-seated mistrust of the people who care for her but she lacks the capacity to decide who cares for her.”

McLaren admitted that on December 9 last year, at Linlathen Neurological Care Centre, he behaved in a threatening or abusive manner by shouting, swearing and throwing items.

Sheriff Brown said: “I accept you do not trust medical services, however I do. They do an important job and you will not stop them from doing their job and being able to provide care by kicking off.”

McLaren was placed on a three-year anti-social behaviour order, prohibiting him from conducting himself in a disorderly manner at the centre and from mistreating, abusing or shouting and swearing at staff or residents there.

The care centre was approached for comment but had not responded by time of going to press.

 

Sex offender caught with child porn videos

A CONVICTED sex offender was caught with child porn videos.

Neil Goodwill, 68, of Westfield Lane, was previously placed on a 10 year sexual offences prevention order (SOPO).

But Dundee Sheriff Court heard he flouted the order a number of times, including when he undertook volunteer work with children at the Dive Bunker, Fife, and at Edinburgh Festival Fringe.

He was also given permission to film a band on a public street in Glasgow but instead filmed children in the audience.

At court he admitted a charge of having indecent images of children at his home address.

Fiscal depute Stewart Duncan said Goodwill told police he had resorted to viewing images online as an “accepted alternative” to his behaviour in those public places.

The fiscal said that the indecent images were found by police when they attended at his home as part of his monitoring. Mr Duncan said: “About 12.30pm on October 14, 2014, two detective constables attended and traced the accused.

“During this visit the accused was asked if he would be willing for the detective constables to conduct a field search of his equipment. He agreed.

“During this search, a header ‘Dutch boys Speedo cute pre-teens’ was noted.

“The accused was cautioned and replied, ‘Don’t know it or recognise it’.”

Goodwill agreed to voluntarily surrender his laptop for further investigation and it was submitted for forensic examination.

This revealed indecent videos of children.

Officers also recovered search terms that were “of concern”.

The fiscal continued: “The accused denied seeking any online images when specifically asked by criminal justice social workers.

“He later stated that he chose to lie about this over fear of being chastised.”

Sentence was deferred until February 26 and Goodwill was remanded meantime.

Dive Bunker owner Mark Blyth said of Goodwill: “He went on a try dive here. He bought a voucher online and turned up and went in the pool, with kids there, when he shouldn’t have.

“He went on a test scuba diving session but didn’t mention his previous history to us.

“He was basically a customer of ours — we have no way of vetting them.”

A spokeswoman for the Edinburgh Festival Fringe declined to comment.

Teenager admits headbutting police officer at court

A TEENAGER who headbutted and repeatedly punched a police officer in a court building is behind bars.

The 16-year-old girl, who cannot be named for legal reasons, carried out the assault on PC Gwen Louden at the reception area of Dundee Sheriff Court.

It took place after she was ejected from the court’s public gallery during the custody court on January 28.

Fiscal depute Stewart Duncan said: “Constable Louden informed the accused she was being arrested.

“PC Louden removed her handcuffs and placed them on the accused’s left arm and PC Tom Anderson took hold of the accused’s right side.

“The accused punched PC Louden on the face with her fist, then headbutted PC Louden on the left side of her face.

“And she again repeatedly punched PC Louden on the face several times.”

PC Louden and PC Anderson continued to struggle with the accused, and they all fell to the ground, where the accused was restrained.

PC Louden went to Ninewells Hospital with facial injuries, including reddening and severe swelling.

On February 20 PC Louden still had a black eye and was off work.

Solicitor David Duncan, defending, said: “She was at court because she is a complainer in a domestic violence case against her.

“That is the world she lives in and what she is used to.”

The teenager admitted one charge against her of assaulting PC Louden by headbutting her on the face and repeatedly punching her on the head and face.

The court heard the youth was currently subject to a community payback order, which she had been failing to comply with.

Sheriff Elizabeth Munro said: “She spends £180 on cannabis a fortnight with her partner then says she doesn’t have money for her bus fare to get to her community work.”

Sentence was deferred until March 24 for psychiatric reports and the youth was remanded meantime.

 

Convicted stalker jailed for three years

A man who gripped a woman in a headlock in front of her son has been jailed for three years.

Dundee Sheriff Court heard the boy thought his mum was dead after Brian Edwards released his grip and the woman “slumped” to the floor unconscious.

The boy then “gently shook her” for a few minutes before she awoke “dazed and confused”.

The court heard the woman did not report the incident to police as she was too frightened but she did report it when the man began stalking her.

Edwards, 29, of Perth Prison, previously admitted one charge of assault and a second charge of stalking.

Fiscal depute Vicki Bell told the court the assault took place at a property in Dundee during an argument between Edwards and the woman.

She said he climbed over the bed, grabbed the complainer and placed her in a headlock. The woman’s son heard shouting and came into the bedroom.

The fiscal said: “Her son thought she was dead as she just slumped to the floor.

“The accused left the room. Her son went over and gently shook her and after a few minutes she awoke and saw her son and the accused. She felt dazed and confused.”

Some time later the woman began receiving a number of text messages and phone calls from Edwards and she changed her number in a bid to stop him contacting her.

Edwards then phoned her from a mutual friend’s phone and thereafter repeatedly from a withheld number. That same day she received 48 text messages from him and three days later she received 140 text messages from him, which included threats of violence and offensive names.

The fiscal said that the woman was frightened Edwards would turn up at her house and subject more violence on her.

The following month she received three letters from him sent from Perth Prison and at that point she contacted police. Solicitor Ann Duffy, defending, said: “He has anger issues and that results in violence.”

Edwards, previously of Arklay Street, admitted one charge of assault to injury between July 1 and September 24 last year, at a property in Dundee. And he admitted a second charge of engaging in a course of conduct which placed a woman in a state of fear and alarm between July 1 and November 5 last year.

Sex offender gets ten years in jail for raping schoolgirl

A high risk sex offender was jailed for 10 years today after raping a schoolgirl and trying to rape another victim.

Derek Gall, 36, preyed on children during an eight-year catalogue of abuse and plied one girl with drink before raping the 13-year-old.

A judge told Gall at the High Court in Edinburgh: “You were found guilty of a substantial number of serious offences over a lengthy period of time.”

Lord Bannatyne said he believed that Gall’s offending had been correctly characterised as “a pattern of sexually abusive behaviour over a substantial length of time”.

The judge pointed out that Gall, formerly of Brougham Gardens, Dundee, had also been assessed as posing a high risk of sexual offending.

Lord Bannatyne ordered that he be kept under supervision for a further period of five years.

The judge told Gall that he would be placed on the sex offenders’ register indefinitely.

Gall had originally faced a total of 23 charges but was convicted of eight offences following an earlier trial. He had denied the charges.

He indecently assaulted and tried to rape one girl at houses in Dundee, Broughty Ferry and Forfar. The abuse began in 2006 when she was aged eight and during attacks he restrained the child and held her down.

Gall raped a girl at a house in Forfar after supplying her with drink and while she was heavily under the influence of alcohol forced her to carry out a sex act. He also had underage sex with the girl.

Defence counsel Edward Targowski QC said: “As far as mitigation is concerned there is very little I can say in relation to the charges, given his position at trial.”

The defence counsel urged Lord Bannatyne to be “as lenient as possible” with his client.

Man admits throwing bottle which left woman disfigured

A 28-year-old man has admitted throwing a bottle in a Dundee nightclub, which hit a woman on the head.

Francis Monaghan, of Ochil Crescent, Stirling, pleaded guilty to one charge on indictment at Dundee Sheriff Court.

Monaghan admitted culpably and recklessly throwing a bottle, striking Debbie Strachen on the head, to her severe injury and permanent disfigurement.

The incident took place at Liquid nightclub, South Ward Road, on March 29 2015.

Sentence was deferred until Tuesday March 29 for preparation of a narrative and reports and assessments.

After the incident Ms Strachan, 31, was operated on by a plastic surgeon and needed 30 stitches in her face.

At the time, doctors told the mum of two that she will likely have three permanent scars on her face as a result of the attack.

Man jailed over theft of sex toys from Dundee home

A man who stole sex toys from a city flat has been jailed for 15 months.

Charles Jamieson, 35, admitted at Dundee Sheriff Court that he stole adult items from a property on Constitution Street.

The court heard he also took a TV, keys, guitar plectrum and a plastic knife from the flat on December 5 last year.

When police arrived at Jamieson’s flat, the stolen sex toys were “strewn” across his living room.

Fiscal depute Vicki Bell said the home occupier left her flat secured at 10pm on December 3.

Two days later a neighbour noticed the flat’s front door was ajar.

The fiscal said: “At 9pm the neighbour saw the accused coming out of the locus carrying a TV concealed under a duvet.

“He asked the accused what he was doing and he said he was helping someone move out. The neighbour was not satisfied with this explanation and contacted police.”

Police arrived and there was no trace of Jamieson.

The home occupier was contacted and later reported a number of items stolen.

On December 8, police received information that Jamieson had been seen in possession of a bag of sex toys.

Officers arrived at his home and saw the items within his flat.

He told police he had been contacted by another male who offered him money to help him “remove” the items.

Solicitor Paul Parker Smith, defending, said: “The sex toys and other items were in full view strewn across the living room. The officers and Mr Jamieson seemed to have been having a bit of a joke about it. He says he was given the items in exchange for helping remove other items.”

Jamieson, a prisoner at Perth, admitted that he stole a television worth £180, a quantity of adult toys, keys, a guitar plectrum and a plastic knife from the flat.

Sheriff Alastair Brown said: “When you go into someone’s home you create feelings of violation and insecurity.

“In this case it was made even worse by the personal nature of some of what you took.”


Woman charged over ‘dog attack’

A WOMAN has been charged in connection with an alleged dog attack on a Dundee street.

The alleged victim was walking along the city’s Old Craigie Road when the incident is said to have taken place.

Police Scotland has confirmed that a 56-year-old woman has been charged in relation to the alleged attack, which is said to have taken place on Tuesday February 23.
A report will be sent to the procurator fiscal.

It is claimed that the woman was attacked by the dog and suffered injuries to her arm, which had to be treated at Ninewells Hospital.

The 53-year-old spent two days receiving treatment.

Police did not provide information about the fate of the dog, however, legislation introduced by the Scottish Government could see it destroyed if the allegations are proved.

The Control of Dogs (Scotland) Act 2010, was introduced to widen the scope for local authorities and courts to take action against persons in charge of a dog where the dog’s behaviour is deemed to be “out of control”.

It allows council-authorised officers allowed to issue Dog Control Notices (DCNs) to irresponsible owners of any dog which it is believed may pose a danger to the public.

The act amends the Dangerous Dogs Act 1991 meaning dog owners can be held criminally responsible where a dog is found to be dangerous.

The Dog Control Notices can impose a number of conditions on the dog owner, including muzzling the animal whenever it is in a place which can be accessed by the public.
Owners can also be ordered to keep the dog on a lead whenever it is in a place in which the public have access.

In the case of male dogs, the owner can be made to neuter their pet.

The owner and their dog can also be required to attend and complete a training course on the control of dogs.

A Scottish Government spokeswoman said: “The decision on whether a dog should be destroyed is a matter for the court to determine.”

A police spokeswoman said officers had been investigating the claims.

She added: “Police Scotland can confirm that a 56-year-old woman has been charged.

“A report will be sent to the procurator fiscal.”

Man faces eight sex charges

A 25-YEAR-OLD man faces eight sex charges involving children.

Michael Grimes will stand trial at Dundee Sheriff Court.

He denies eight charges against him, all of which are of a sexual nature involving children.

Grimes denies sending written communication of a sexual nature to four different children via social media, in which he used sexual language.

And he denies making three children look at sexual images of his own private parts by sending them via social media.

He also denies a further charge of using lewd, indecent and libidinous practices and behaviour towards a child.

All of the charges are alleged to have happened between March 2007 and March 2015, at properties in Angus towns and elsewhere.

Grimes, of Wharf Street, Montrose, will stand trial on March 14.

Man brandished knife at youths who tried to force his way into his flat

A man who brandished a knife at a rioting mob of youths has been admonished after a sheriff ruled he was acting in defence of his pregnant sister.

The group of up to 30 youths repeatedly pushed community wardens as they tried to barge their way into a common close on Malcolm Street.

They shouted and screamed in an attempt to follow Matthew McLaughlan, 31, into his flat and one male youth made it into the close where he discarded a large knife.

Moments later, McLaughlan appeared at the front door of the close, waving the knife at the youths and shouting as he attempted to get his pregnant sister into the close.

Dundee Sheriff Court was shown footage of the incident captured on the body camera of one of the community safety wardens involved.

The female warden could be heard contacting police and repeatedly screaming “it’s going mental” and “it’s nuts”.

She shouted: “There’s an adult male who went into the close and came out with the biggest knife I’ve ever seen.”

Fiscal depute Vicki Bell told the court the block of flats was directly opposite a playpark which has been plagued by anti-social behaviour.

She said that on May 15 last year up to 30 youths were drinking there all day and three arrests had been made prior to the riot. McLaughlan returned home around 10.10pm by which point community wardens were on the scene due to the youths’ behaviour and he was “jostled” as he attempted to get inside the block.

His pregnant sister heard a disturbance outside and went out to help her brother. McLaughlan went up to his flat where he was told by his mum that his sister was still outside.

He then picked up the discarded knife and returned to the close where he stood holding the 30cm knife at shoulder height and pointing it towards the youths.

Solicitor Nicola Brown, defending, said: “Clearly if he shut the door once she was inside he could have pleaded self-defence but he stood there for quite some time after which is why this plea has been entered.”

McLaughlan, of Malcolm Street, admitted having a knife in a public place, on May 15 last year, at Malcolm Street.

Sheriff Alastair Brown said: “You were in a position where your sister was outside in a riotous mob of evilly disposed morons and vulnerable. I can see why it could be said you were acting in her defence until she was back in the close.

“I can also see that it could be said you stayed there too long but thinking clearly in that situation must have been very difficult. This is a wholly exceptional case and you will be admonished.”

Pair face trial charged with murdering woman and chopping up body

TWO people are to stand trial charged with murdering a woman and chopping up her body.

Steven Jackson, 40, and Michelle Higgins, 28, are accused of killing Kimberley MacKenzie at a flat in Montrose, Angus last October.

Prosecutors claim the 37 year-old was struck with a hammer, machete and knife or similar items.

Jackson and Higgins then face an allegation of attempting to defeat the ends of justice.

It is claimed Kimberley’s body was dismembered using a saw, knives and a screwdriver or similar instruments.

Parts of the corpse are said to have been wrapped in bin liners and bags and hidden in bins at a number of addresses in Montrose.

It is further alleged Kimberley’s head and other body parts were put inside a rucksack and case and concealed in a shower cubicle.

Walls, floors and other surfaces of the alleged murder flat are said to have been cleaned.

Caustic soda and bleach are also alleged to have been poured into a bath. Clothes and footwear are finally said to have been disposed of.

The charge claims this was all done “with intent to avoid detection, arrest and prosecution”.

The accusation spans the day of the alleged killing and November 4 last year.

Jackson is further charged with two separate drugs accusations as well as having a machete in a public place.

Higgins faces a similar allegation of having a knife.

The pair today appeared for a short hearing at the High Court in Glasgow.

Jackson’s QC Donald Findlay and Higgins lawyer Mark Stewart QC each pled not guilty on their behalf.

Judge Lady Scott set a trial due to take place in September in Edinburgh.

Man guilty of child sex offences in Dundee

A 56-year-old man has been found guilty of five charges involving children at Dundee Sheriff Court.

A jury found Stewart King, of Forres Avenue, guilty of three child assault charges, engaging in sexual activity with a child and indecently assaulting a child.

King was found guilty after trial of assaulting three youngsters on various occasions between 2010 and 2014, at a property in Dundee.

He assaulted one child on various occasions by punching the child on the head and body and throwing objects at the youngster.

King further assaulted a second child on various occasions by punching and kicking the child on the head and body and kicking the child on the legs, all to the child’s injury.

He further assaulted a third child on various occasions by seizing hold of the child by the clothing, lifting the child off the ground, pushing the child against a wall, punching the child on the head and body and kicking the child on the legs, all to the child’s injury.

He also engaged in sexual activity with a child, on various occasions between 2013 and 2014, also at a property in Dundee.

And he indecently assaulted a fourth child, on various occasions between 2005 and 2006, at a property in Dundee.

Sentence was deferred until April 5 for reports.

King also had his name added to the sex offenders register meantime.

Man who brandished knife tells of ‘constant abuse’ from rioting youths

A MAN who was admonished for brandishing a knife at a group of rioting youths has spoken of the “constant abuse” he received in the run-up to the incident.

Matthew McLaughlan, 31, admitted at Dundee Sheriff Court that he had brandished the knife but said he had done so in defence of his pregnant sister, with Sheriff Alastair Brown admonishing him.

Mr McLaughlan today told the Tele that the incident had seriously affected his family, including his sister, Nicole Collins, and her daughter Alicia, who Nicole was pregnant with at the time of the knife incident, which happened on Malcolm Street.

He said: “Me, my brother, my cousin and my sister have all moved house from around about the area because of this.

“The youths were all drunk and out of their faces on drugs so it was lucky it happened the way it did. There was about 30 of them going mental.

“My sister had to go to the midwife not long after the hassle with the knife and it looks like it’s damaged the baby.

“She’s in Ninewells at the moment. The consultant thinks there’s a link with the baby’s issues and what happened in the close. She has to be fed through a tube.

“She’s just trying to get on with things as best she can. We were all just glad to get the court case over with.

“I’ve got nothing to say to the kids who were involved, my sister’s kid’s more important.”

Siobhan McLaughlan, Matthew and Nicole’s other sister, said the incident had left her mother almost housebound out of fear of reprisal.

She said: “My mum had to move through fear. In the eyes of the people who were involved in the fight, they’ll see the result of the case as my brother getting away with it.
Because of that she’s almost never leaving the house, although she did move house since the fight happened.

“She’s even thinking about moving back to Eastbourne, where I live.

“She’s terrified there’s going to be some sort of payback. My brother did what he did to protect his family.”

Discussing baby Alicia, who was born in October, Siobhan said: “The consultant asked my sister if she had been bumped during pregnancy and she said ‘no’, but then my mum reminded her she had, during the fight.

“We’re waiting on some answers.

“She has a meeting with doctors on Friday.

“Whether it’s something like epilepsy or she needs major surgery, it’s a huge worry for us.”

 

Man threatened to throw woman out of Dundee hotel window

A 51-year-old man threatened to throw his partner out of a hotel window.

William Carmichael, of Blackwood Avenue, Linwood, Renfrewshire, admitted three charges against him at Dundee Sheriff Court.

He admitted assaulting his partner Valerie Lee at Holiday Inn Express on Dundee’s Dock Street by threatening to throw her out of a window there, seizing her by the hair and biting her on the lip, all to her injury, on August 30 last year.

He further admitted assaulting Scott Spink by attempting to butt him on the head on the same date and location.

And he admitted behaving in a threatening or abusive manner by shouting, swearing and threatening to kill three police officers, at Commercial Street, during a journey to police headquarters, and at the charge bar area of police headquarters on the same date.

Sentence was deferred until May 2.


Four appear in Dundee Sheriff Court over ‘drugs’ find

Two pensioners and a pair in their 30s appeared in private at Dundee Sheriff Court today, charged with dealing drugs.

It followed a police operation in the St Mary’s area of the city on Friday, when officers recovered £97,000 worth of substances.

Alan Golding, 66, of Whitwell Road, Southsea, Portsmouth, and Carole Blissett, 68, of Lewes Close, Bognor Regis, West Sussex — along with Kevin Craig, 39, of Balunie Crescent, and Wendy Massie, 30, of St Fillans Road, Dundee, made no plea or declaration in relation to two charges on petition.

All four accused are charged with being concerned in the supply of cocaine, a class A drug, at a property on St Fillans Road, on Friday.

The four accused are also facing a second charge of being concerned in the supply of cannabis, a class B drug, on the same date and location.

The case was continued for further investigation and all four were released on bail.

Man facing string of sex allegations

A Tayside man has been charged with a string of sexual offences, including rape.

Scott Williams is facing a total of 10 allegations, which also include abduction and possessing extreme porn.

The 30-year-old man is also accused of indecently assaulting a child on a carnival ride in Dundee as well as telling a mother that he wanted to commit sexual acts on her children.

The offences are said to have occurred during a spell close to eight years long, between April 2006 and March 2014.

Williams, whose address was given as Great Michael Road, Arbroath, first appeared for a preliminary hearing at Glasgow High Court.

He denied the charges and is now set to face trial at the High Court in Aberdeen, beginning on March 18.

The earliest offences against one woman are said to have been committed by Williams between April 2006 and September 2008.

The allegations include indecently assaulting, raping and locking the woman in a house in Angus without food or electricity and against her will on various occasions.

Between 2007 and 2008, it’s alleged Williams indecently assaulted a child while on a carnival ride at Dundee’s Riverside. There are another two charges of indecent assault against Williams involving another woman, one of which is said to have occurred in the back seat of a car.

Williams has further been charged with a breach of the peace after allegedly repeatedly telling a third woman in Angus, between 2013 and 2014, that he wished to have access to her children so he could engage them in sexual acts.

His behaviour is said to have caused the mother of the children “fear and alarm”.

Williams also allegedly coerced the same woman to view various pornographic images without her consent and without a reasonable belief that she was consenting.

It’s claimed that he sought to induce her to comment on them for his own sexual gratification.

Thug glassed former colleague on night out in Dundee

A thug glassed a man at a city centre pub — months after he had glassed his own partner in a Dundee clubbie.

Sean McLeod, 28, was jailed for 35 months after admitting two assault charges at Dundee Sheriff Court. The court heard he carried out one vicious assault on Saturday December 12 at Cask & Cork pub in the Seagate.

Fiscal depute Nicola Gillespie said: “The complainer Garry Griffin was on a work’s Christmas night out in the city centre and was in the Cask & Cork at around 11.40pm along with work colleagues.

“He became aware of the accused, whom he recognised as someone he used to work with.

“A colleague spoke to Mr Griffin and told him to avoid the accused as he believed the accused had an issue with Mr Griffin relating to his dismissal from his job.”

Mr Griffin was not aware of there being any issue but he took heed of this advice.

The fiscal continued: “A couple of minutes later, the accused approached Mr Griffin and without warning grabbed him by the throat.

“The accused was shouting at Mr Griffin that he was glad he had been dismissed from his job.

“Mr Griffin stepped back from the accused and turned to pick up his jacket. The accused then threw a glass at Mr Griffin, striking him on the forehead above his right eye.”

McLeod then walked out of the pub as others tended to Mr Griffin, who was bleeding from his injury.

Police and ambulance were contacted and Mr Griffin was taken to A&E at Ninewells Hospital.

McLeod was traced nearby by police. He was arrested and taken to police headquarters where he was cautioned and charged.

The court heard McLeod also carried out a similar assault on April 24 last year, when he glassed his partner Gordon Rice. This assault took place at the Dee Club, on Taylor Street, and on the street outside the club. McLeod struck Mr Rice on the head with a glass and repeatedly stamped on his head and body.

McLeod, a prisoner at Perth, admitted assaulting Garry Griffin by seizing him by the throat and throwing a glass at him, striking him on the head to his severe injury and disfigurement, at Cask & Cork, Seagate, on December 12, while on bail. And he admitted assaulting his partner, Gordon Rice, by repeatedly stamping on his head and body, and striking him on the head with a glass, to his severe injury, at Taylor Street and at the Dee Club, on April 24 last year.

He was jailed for 20 months for the assault on Mr Griffin and he was jailed for a further 15 months for the assault on Mr Rice. The two sentences will run consecutively.

Man in court over ‘attempted armed robbery’ in street

A man has been charged following an alleged attempted armed robbery in a northern Fife town.

Two males were held after police were called to a street in Cupar late last month.

One was charged with two attempts to rob someone of cash while using a knife, while the other faces claims that he assaulted the same two people.

Barry Kidd, 35, of the town’s Balgarvie Crescent, has now appeared in private at Dundee Sheriff Court in connection with the incident.

He made no plea or declaration in relation to two charges on petition.

Kidd is charged with attempting to rob another man, Steven Keddie, by presenting a knife at him and demanding money from him, at Burnside, Cupar, on February 26.

He is further charged with attempting to rob a second man — Ross McMahon — by presenting a knife at him and demanding money from him, on the same date and at the same location.

The case was continued for further investigation and Kidd was remanded meantime.

In a separate summary case, relating to the same alleged incidents, Shaun Rowley also appeared at Dundee Sheriff Court.

Rowley, 31, also of Balgarvie Crescent, denied two charges against him.

He denies assaulting Mr Keddie by punching him repeatedly on the head, to his injury, at Burnside, Cupar, on February 26.

Rowley further denies assaulting Mr McMahon by punching him repeatedly on the head, to his injury, on the same date and at the same location.

He will stand trial for these two charges on May 5 with an intermediate diet on April 21.

The most recent police figures, released in late February, show that there were 39 robberies or assaults with intent to rob in the Fife Council area in the first three-quarters of this financial year.

That was a drop from 51 in the same period the previous year.

Of the 39, only one was not detected by police — meaning more than 97% of the alleged crimes were solved.

However, there was a substantial rise in common assaults across Fife year-on-year.

Up to December, there were 3,205 incidents — compared to 2,902 in the same period the year before.

Police officers allegedly abducted by woman in house

A woman has been charged with abducting Tayside police officers.

It’s alleged that the officers were detained inside a property by Cheyrell Davie while they were there investigating a separate matter. The 35-year-old, formerly of Dundee, was also accused of firearm and drugs offences following the incident in Angus on Friday.

Meanwhile, a 30-year-old man, Phillip Moreton, has been charged with a series of offences in connection with the same incident at Glen Prosen.

Moreton is alleged to have made or attempted to make use of a firearm or imitation firearm with the intention to resist or prevent arrest or detention.

Moreton is further charged with one count of culpable and reckless conduct.

The duo — whose current addresses were both given as the Kirriemuir area — also both face a charge that they possessed — or purchased, acquired, manufactured, sold or transferred — a weapon designed or adapted for the discharge of a noxious liquid, gas or other item.

Davie and Moreton are also charged with the production of a controlled drug.

Meanwhile, it’s alleged that Moreton twice attempted to pervert the course of justice.

He also stands accused of resisting, obstructing or hindering police who were at the scene. Moreton, also previously of Dundee, is further charged with threatening or abusive behaviour.

Davie is also accused of behaving in the same manner — while she has been charged with two counts of resisting, obstructing or hindering police officers.

Both made no plea or declaration when appearing at Forfar Sheriff Court on Monday and they were committed for further examination.

Moreton was remanded in custody and Davie was given bail.

A Police Scotland spokeswoman said: “Police Scotland can confirm that a 30-year-old man and 35-year-old woman have been charged in connection with an incident at Glen Prosen on Friday. A report has been submitted to the procurator fiscal.”

David Hamilton, chairman of the North Area Committee of the Scottish Police Federation, said the allegations were “concerning” and highlighted “the type of risks police officers can encounter anywhere at any time”.

Support arrangements have been put in place for the officers said to have been involved in what he described as a “difficult incident”.
